Relationship to other standards governing home and community-based services. (a) For purposes of this subdivision, "medication administration" means: (1) checking the person's medication record; (2) preparing the medication as necessary; (3) administering the medication or treatment to the person; (4) documenting the administration of the medication or treatment or the reason for not administering the medication or treatment; and. Committee, Side by Side The license holder must correct building and equipment deterioration, safety hazards, and unsanitary conditions. (b) Physical contact or instructional techniques must use the least restrictive alternative possible to meet the needs of the person and may be used: (1) to calm or comfort a person by holding that person with no resistance from that person; (2) to protect a person known to be at risk of injury due to frequent falls as a result of a medical condition; (3) to facilitate the person's completion of a task or response when the person does not resist or the person's resistance is minimal in intensity and duration; (4) to block or redirect a person's limbs or body without holding the person or limiting the person's movement to interrupt the person's behavior that may result in injury to self or others with less than 60 seconds of physical contact by staff; or. These programs are available to persons who choose to reside in the community and meet the eligibility criteria. Interventions Support Services. (b) Mechanical restraint does not include the following: (1) devices worn by the person that trigger electronic alarms to warn staff that a person is leaving a room or area, which do not, in and of themselves, restrict freedom of movement; or. Action taken by the license holder must include, at a minimum: (1) consultation with the person's support team or expanded support team to identify and resolve issues leading to issuance of the termination notice; (2) a request to the case manager for intervention services identified in section 245D.03, subdivision 1, paragraph (c), clause (1), or other professional consultation or intervention services to support the person in the program. Food must be obtained, handled, and properly stored to prevent contamination, spoilage, or a threat to the health of a person. This information must be readily available to all staff administering the medication; (3) the possible consequences if the medication or treatment is not taken or administered as directed; (4) instruction on when and to whom to report the following: (i) if a dose of medication is not administered or treatment is not performed as prescribed, whether by error by the staff or the person or by refusal by the person; and. Authorization must be obtained within five working days of service initiation and renewed annually thereafter. (g) For notices issued under paragraph (b), clause (7), the lead agency shall provide notice to the commissioner and state-operated services at least 30 days before the conclusion of the 90-day termination period, if an appropriate alternative provider cannot be secured. (c) The staff person must review and receive instruction on the person's support plan or support plan addendum as it relates to the responsibilities assigned to the license holder, and when applicable, the person's individual abuse prevention plan, to achieve and demonstrate an understanding of the person as a unique individual, and how to implement those plans. "Psychotropic medication" means any medication prescribed to treat the symptoms of mental illness that affect thought processes, mood, sleep, or behavior. (a) The license holder must provide services in response to the person's identified needs, interests, preferences, and desired outcomes as specified in the support plan and the support plan addendum, and in compliance with the requirements of this chapter. The review must include an evaluation of whether: (1) the person's service and support strategies developed according to sections 245D.07 and 245D.071 need to be revised; (2) related policies and procedures were followed; (3) the policies and procedures were adequate; (4) there is a need for additional staff training; (5) the reported event is similar to past events with the persons, staff, or the services involved; and. "License holder" has the meaning given in section 245A.02, subdivision 9. A person's service-related rights include the right to: (1) participate in the development and evaluation of the services provided to the person; (2) have services and supports identified in the support plan and the support plan addendum provided in a manner that respects and takes into consideration the person's preferences according to the requirements in sections 245D.07 and 245D.071; (3) refuse or terminate services and be informed of the consequences of refusing or terminating services; (4) know, in advance, limits to the services available from the license holder, including the license holder's knowledge, skill, and ability to meet the person's service and support needs; (5) know conditions and terms governing the provision of services, including the license holder's admission criteria and policies and procedures related to temporary service suspension and service termination; (6) a coordinated transfer to ensure continuity of care when there will be a change in the provider; (7) know what the charges are for services, regardless of who will be paying for the services, and be notified of changes in those charges; (8) know, in advance, whether services are covered by insurance, government funding, or other sources, and be told of any charges the person or other private party may have to pay; and.
